This Terms & Conditions document governs relations with Users (Buyers) - anyone registering to browse, order, and pay for products on the platform.

PART ONE - GENERAL TERMS & PLATFORM USE

This volume establishes the legal relationship between the customer (buyer) and PASTAEBASTA platform.

1. Introduction

Welcome to PASTAEBASTA (the “Platform,” “we,” “us,” “our”). These Terms & Conditions for Users (Buyers) (the “Buyer Terms”) govern your registration, browsing, and purchasing activity on the Platform when you act as a customer.

If you are a photographer or creator uploading content to PASTAEBASTA, a separate document - the existing Terms of Use for Creators and the Photographer Licensing Agreement - applies to your activity as a contributor. These Buyer Terms apply to you in addition to those documents whenever you place an order as a buyer, including if you are also a registered creator.

2. Definitions

For the purposes of these Buyer Terms:

“Platform” means the website located at pastaebst.com (or its successor domain[s]), together with any associated mobile applications.
“Company,” “PASTAEBASTA,” “we,” “us” means Portalio S.R.L. (see Section 4).
“User” or “Buyer” means any natural person who registers an account, checks out as a guest, or otherwise places an Order on the Platform.
“Creator” or “Photographer” means a contributor governed by the separate Terms of Use for Creators and Photographer Licensing Agreement.
“Products” means any physical or digital goods offered for sale on the Platform, including but not limited to apparel, prints, stickers, and other merchandise described in Part Two.
“Order” means a purchase proposal submitted by a Buyer through the Platform’s checkout process.
“Contract” means the contract of sale formed between the Buyer and the Company upon acceptance of an Order, as described in Section 22 (Order Acceptance).
“Consumer” means a Buyer who is a natural person acting for purposes outside their trade, business, craft, or profession, consistent with the definition in the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005) and Directive 2011/83/EU.
“Content” means photographs, text, reviews, images, and other material appearing on the Platform.
“Payment Service Provider” or “PSP” means the third-party payment processors identified in Section 27.

3. About PASTAEBASTA

PASTAEBASTA is a platform born from city-based photography competitions, where winning and selected photographs are turned into physical products - apparel, prints, and other merchandise - organized into curated Collections (see Section 17). PASTAEBASTA operates as a direct retailer: every Product sold on the Platform is sold directly by the Company (Portalio S.R.L.), not by the individual Creators whose photography is featured, and not by any third-party marketplace seller. The Company is the sole seller of record and counterparty to every Contract formed under these Buyer Terms.

Creators retain ownership of their underlying photographs and receive a royalty/revenue share under the separate Photographer Licensing Agreement; that arrangement is a matter between the Company and the Creator and does not alter the Buyer’s Contract, which is always with the Company alone.

References in these Buyer Terms to “the Company,” “we,” “us,” and “our” mean Portalio S.R.L.

5. Scope of These Terms

These Buyer Terms apply to:

(a)browsing the Platform’s storefront and product catalogue;
(b)registering a Buyer account;
(c)placing Orders, whether as a registered User or as a guest (Section 9);
(d)making payments for Products;
(e)any post-purchase interactions, including delivery, returns, and customer support.

These Buyer Terms do not govern: (i) your activity as a Creator (governed by the Terms of Use for Creators and the Photographer Licensing Agreement); (ii) our processing of your personal data (governed by the Privacy Policy); or (iii) our use of cookies (governed by the Cookie Policy). Where those documents conflict with these Buyer Terms on a matter within their specific scope, the more specific document controls.

6. Acceptance of the Terms

By creating a Buyer account, checking the “I agree to the Terms & Conditions” box at checkout, completing a guest checkout, or otherwise placing an Order, you confirm that you have read, understood, and accepted these Buyer Terms, and that such acceptance carries the same legal effect as a handwritten signature, consistent with Italian law on distance-contract formation (Articles 1326 and 1336 et seq. of the Italian Civil Code) and the Italian e-commerce framework (Legislative Decree 70/2003, implementing Directive 2000/31/EC).

If you do not agree to these Buyer Terms, you must not register an account or place an Order.

7. Amendments to the Terms

We may update these Buyer Terms from time to time to reflect changes in our services, Products, payment or shipping partners, or applicable law. When we make material changes, we will:

(a)update the “Last updated” date at the top of this document;
(b)[CONFIRM NOTICE METHOD: e.g., email notice to registered Users / a banner notice on the Platform / both] before the changes take effect.

Changes apply prospectively only: any Order placed before a change takes effect is governed by the version of these Buyer Terms in force at the time that Order was placed. Continued use of the Platform after changes take effect constitutes acceptance of the revised Buyer Terms.

8. Eligibility (18+ to Purchase)

You must be at least 18 years old and have full legal capacity to enter binding contracts to place an Order, or make a payment on the Platform. This is distinct from the minimum age of 16 that applies to general platform activities such as voting, described in the Terms of Use for Creators - that lower age threshold covers browsing and community participation, not the formation of a purchase Contract.

If you are under 18, you may browse the Platform but you may not place an Order, or submit payment details.

By placing an Order, you represent and warrant that you meet this age and capacity requirement. We reserve the right to request proof of age and to cancel any Order where we reasonably believe this requirement has not been met.

9. Customer Accounts

You may register an account by providing LIST REQUIRED FIELDS: e.g. name and surname, email, password, date of birth. You agree that all information you provide is accurate, current, and complete, and you agree to keep it updated.

An account gives you access to: saved addresses and payment methods, wishlist/favourites, and any loyalty or promotional features described in Section 32 (Promo Codes) and Section 33 (Gift Cards).

Registration is free. Creating an account does not, by itself, create a Contract for the purchase of any Product; a Contract is formed only as described in Section 22.

10. Guest Checkout

You place an Order without registering a Buyer account (“Guest Checkout”). Guest Checkout requires you to provide the same order and delivery information as a registered Buyer, and it is subject to these Buyer Terms in full, including the age requirement in Section 8. Guest Checkout Orders will not appear in an order-history dashboard unless you subsequently register an account using the same email address.

11. Account Security

You are responsible for maintaining the confidentiality of your account credentials (email/username and password) and for all activity that occurs under your account. You must notify us immediately at team@pastaebst.com if you suspect unauthorised access to, or use of, your account.

To the extent permitted by applicable law, the Company is not liable for any loss or damage arising from your failure to safeguard your credentials, except where such loss results from the Company’s own negligence, wilful misconduct, or a security failure on our systems.

We recommend using a strong, unique password and enabling any additional security features we make available in the future.

12. Suspension and Termination

We may suspend or terminate your Buyer account, or refuse to process an Order, where:

(a)you breach these Buyer Terms;
(b)we reasonably suspect fraud, payment abuse, chargeback abuse, or manipulation of promotional offers;
(c)required by law, regulation, or a competent authority;
(d)you provide false, inaccurate, or misleading information;
(e)your account has been inactive for 360 days and closure is necessary for data-minimisation purposes under our Privacy Policy.

Where reasonably possible, we will notify you of a suspension or termination and the reason for it. Suspension or termination of your account does not affect the validity of Contracts already formed for Orders placed before the suspension/termination, nor your statutory consumer rights in relation to those Orders.

You may close your own account at any time by contacting team@pastaebst.com, subject to completion of any pending Orders, returns, or payment disputes.

13. Future Features

The Platform is under active development. We may introduce new features, Product categories, Collections, payment methods, or services at any time, and we may modify or discontinue existing features. Where a new feature involves materially different terms (for example, a subscription service or a loyalty programme), we will publish supplementary terms for that feature, and those supplementary terms will apply alongside - and, where inconsistent, will take precedence over - the general provisions of these Buyer Terms for that specific feature only.

14. Acceptable Use

When using the Platform as a Buyer, you agree that you will:

(a)provide accurate registration, order, delivery, and payment information;
(b)use the Platform only for personal, non-commercial purchases, unless you have our prior written consent to purchase for resale;
(c)comply with all applicable laws, including export control and customs regulations for your delivery destination;
(d)not attempt to circumvent security measures, rate limits, or fraud-prevention controls;
(e)not use the Platform in any way that could damage, disable, overburden, or impair it, or interfere with any other user’s use of it.

16. Prohibited Activities

Without limiting Section 15, you must not:

(a)use another person’s payment details without authorisation;
(b)place Orders using false identity or delivery information;
(c)exploit promotional codes, gift cards, or discounts in a manner inconsistent with their stated terms (see Sections 32–33), including through the creation of multiple accounts to claim single-use offers repeatedly;
(d)resell Products purchased on the Platform in a manner that falsely implies an affiliation with, or endorsement by, PASTAEBASTA or the featured Creator, or that infringes the intellectual property rights described in Part Four;
(e)scrape, crawl, or use automated means to extract Platform data, pricing, or Product catalogue information (see Part Four, Section 47, Website Scraping) or to place Orders at a rate inconsistent with normal individual consumer behaviour;
(f)use the Platform, its Content, or purchased Products to train, fine-tune, or benchmark artificial intelligence or machine-learning models, except as expressly permitted in writing (see Part Four, Section 47, AI Restrictions).

Violation of this Section may result in Order cancellation, account suspension or termination under Section 12, and, where applicable, referral to law enforcement.

17. Intellectual Property

All Platform Content - including the PASTAEBASTA name, logo, site design, catalogue text, and any photography licensed for display - is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws. Purchasing a Product grants you no rights in the underlying photograph, design, or Platform Content beyond your ownership of the physical Product itself; see Part Four, Sections 44–46 for full detail on copyright, trademarks, photography rights, and what a Buyer may and may not do with purchased items.

18. Website Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted, error-free, or continuous access. The Platform may be unavailable due to maintenance, updates, technical failure, or events outside our reasonable control (see Part Four, Section 51, Force Majeure). We are not liable for any loss arising from temporary unavailability, except as set out in Part Four, Section 49 (Liability).

We reserve the right to modify, suspend, or discontinue any part of the Platform’s functionality at any time, provided that this does not affect Orders already accepted under Section 22.

19. Third-Party Services

The Platform integrates with third-party service providers, including payment processors (Section 27), shipping carriers (Part Three, Section 34), and, where applicable, marketing or analytics tools described in our Privacy Policy and Cookie Policy. Your use of those third-party services may be subject to their own terms and privacy policies, which we encourage you to review. We are not responsible for the acts or omissions of independent third-party providers, except to the extent required by applicable consumer-protection law or expressly stated in these Buyer Terms.

PART TWO - PRODUCTS, ORDERS & PAYMENTS

This is the commercial part of these Buyer Terms - it governs what you can buy, how an Order becomes a binding sale, and how you pay for it.

21. Collections

Products are organised into curated Collections tied to the city-based photography competitions described in the Terms of Use for Creators. The Collections currently offered are:

CITY COLLECTIONCollection with real photos captured by people in real cities. Selected through community votings and transformed into real life city collections.

Stock

CITY EXCLUSIVE COLLECTIONA limited artist edition of the City Collection. Each piece is individually decorated and reinterpreted by local artists - handmade, unique, and never exactly repeated.

Made-to-Order | Artist Finished | Limited Edition

BASIC COLLECTIONMinimal collections focused on words, emotions, and city vibes — expressed through typography instead of photography.

Stock

BASIC EXCLUSIVE COLLECTIONA hand-finished artist edition of the Basic Collection. Local artists add custom details, paint, and visual interpretations, making every piece unique.

Made-to-Order | Artist Finished | Limited Edition

We may add, retire, or modify Collections at any time. Retiring a Collection does not affect Orders already accepted under Section 22.

22. Product Descriptions

We make reasonable efforts to ensure that Product descriptions, images, materials, dimensions, and pricing displayed on the Platform are accurate. However:

(a)colours and finishes may appear differently depending on your device’s screen settings (see Section 23);
(b)hand-finished or made-to-order items (Sections 25–26) may show minor natural variation from the reference photo, which is not a defect;
(c)if we discover a clear and obvious error in a Product’s description, price, or availability after you place an Order, Section 22 of Part Two below (Order Acceptance) explains how that is handled.

Product descriptions do not constitute a contractual guarantee of exact colour, texture, or material match beyond what is expressly stated on the Product page.

23. Colours

Displayed colours are indicative. Screen calibration, lighting, and photography conditions can cause the colour you see on the Platform to differ from the physical Product. Where a Product is hand-painted or otherwise individually finished (Section 26), colour and pattern will vary piece to piece by nature of the production method; this is not treated as a defect for the purposes of Part Three, Section 39 (Defective Products), unless the variation is outside the range shown/described on the Product page.

24. Sizes

Size charts are provided on each applicable Product page pup up screen. You are responsible for selecting the correct size using the provided chart before completing your Order. Incorrect size selection by the Buyer is treated under the returns rules in Part Three (Sections 36–40), not as a Product defect.

25. Availability

Product availability is displayed on each Product page and updates in real time where technically possible, but availability is not guaranteed until Order acceptance under Section 22. Placing an item in your cart does not reserve it. If a Product becomes unavailable after you submit an Order but before we accept it, Section 22 (Order Acceptance) governs.

26. Stock Products

“Stock Products” are pre-produced items held in inventory and shipped promptly after Order acceptance, subject to the delivery timelines in Part Three, Section 34.

27. Made-to-Order Products

“Made-to-Order Products” are produced only after you place an Order (e.g., print-on-demand apparel, framed prints produced to size). Because production begins on your specific Order:

(a)the estimated Production Time shown on the Product page (see Part Three, Section 35) applies before shipping timelines begin to run;
(b)Made-to-Order Products are excluded from the statutory right of withdrawal as goods “made to the consumer’s specifications or clearly personalised” (Art. 59(1)(c) Codice del Consumo / Art. 16(c) Directive 2011/83/EU) - this depends on whether the item is genuinely customised to the individual Buyer (e.g., name/size chosen from standard options is usually not enough to lose withdrawal rights; a bespoke crop/personal engraving typically is enough). See Part Three, Section 37.

28. Artist Finished Products

“Artist Finished Products” are items that include a hand-applied or hand-finished element completed by the featured Creator or a Company-engaged artisan (for example, hand-painted or hand-signed pieces). Given the individual, non-repeatable nature of the finishing work, Artist Finished Products are treated as customised/personalised goods excluded from the statutory withdrawal right under Section 37.

29. Limited Editions

“Limited Editions” are Products produced in a capped, disclosed quantity and, once sold out, will not be restocked in the same form. The edition size, and where applicable an edition/serial number, will be stated on the Product page. Limited Edition status does not, by itself, remove your statutory withdrawal rights (Part Three, Section 37) unless the item also qualifies as Made-to-Order or Artist Finished under Sections 27–28.

30. Order Process

To place an Order you will: (a) select Product(s), size/variant, and quantity; (b) review your cart; (c) provide or confirm delivery details; (d) select a payment method (Section 27 below [cross-check numbering - will renumber in final compile]); (e) review the Order summary, including itemised price, taxes, and shipping cost, on a final confirmation screen before submitting; and (f) submit the Order.

Before submitting, you will have the opportunity to review and correct input errors (product, size, quantity, delivery address, and payment details) in accordance with Article 51 of the Italian Consumer Code / Article 8 of Directive 2000/31/EC.

31. Order Acceptance

Submitting an Order is an offer by you to purchase the selected Product(s) at the price and on the terms shown; it is not yet a binding Contract.

(a)Acknowledgment. Upon submission, we will send you an automatic order-acknowledgment email. This acknowledgment confirms receipt only and does not constitute our acceptance of your Order.
(b)Acceptance. A binding Contract of sale is formed only when we send you a confirmation email confirming that your Order has been accepted and is being fulfilled. That email will include a summary of the Contract, including these Buyer Terms and the applicable return information.
(c)Right to decline. We may decline to accept an Order, in whole or in part, where: the Product is unavailable or out of stock after all; we identify an obvious pricing or description error; we suspect fraud, abuse, or a breach of these Buyer Terms; the delivery destination is unsupported (Part Three, Section 34); or payment authorisation fails (Section 31, Failed Payments). If we decline your Order after payment has been captured, we will refund you in full within 14 days.
(d)Obvious errors. If a Product is listed at a price or with a description that contains an obvious and unmistakable error (for example, a missing decimal point), we are not obliged to sell at the erroneous price or on the erroneous terms, even after sending an acknowledgment email. We will contact you to offer the Product at the correct price/terms or to cancel the Order with a full refund.
(e)Language. These Buyer Terms and the Contract are concluded in English and Italian, and in case of conflict English will prevails.
(f)Order records. A copy of your Order and these Buyer Terms will be sent to your email. We recommend saving a copy for your records.

32. Pricing

All prices are displayed in EUR and are valid at the time of display, subject to change at any time before an Order is accepted under Section 22(b). The price applicable to your Order is the price shown at the time you submit it, provided we accept the Order at that price.

Displayed prices include applicable VAT for deliveries within the EU (see Section with VAT) and, where applicable, standard shipping is shown separately at checkout before you submit your Order. Prices exclude any import duties, taxes, or customs charges applicable to deliveries outside the EU/Italy, unless expressly stated otherwise (see Part Three, Section 34, Customs).

33. VAT

Portalio S.R.L. is registered for VAT in Italy under number IT04842640163.

For Buyers located in Italy and the EU or outside EU, the price shown includes Italian VAT at the applicable rate (e.g. 22% standard rate).

A VAT-compliant invoice/receipt will be provided automatically by email for every completed Order.

34. Payment Methods

We accept the following payment methods, subject to availability in your country and the specific terms below:

Cryptocurrency payments (other supported cryptocurrencies, listed at checkout)

Card and digital-wallet payments (Visa, Mastercard, Apple Pay, Google Pay, Revolut Pay) are processed by [PAYMENT PROVIDER NAME - FINALISING; per your note, this relationship is still being finalized], a licensed payment service provider. We do not store full card numbers on our own servers; card data is transmitted directly to the processor via an encrypted, PCI-DSS-compliant connection.

PASTAEBASTA accepts cryptocurrency payments through authorised third-party payment providers. Depending on the selected payment method, your transaction is securely processed by one of our authorised partners. You can pay directly from your crypto wallet without creating an additional account. PASTAEBASTA does not provide cryptocurrency exchange, custody, wallet, brokerage, or virtual asset services. All cryptocurrency transactions are processed exclusively by independent, authorized Providers. PASTAEBASTA is not responsible for blockchain network delays, transaction failures resulting from incorrect wallet addresses or networks, or technical issues occurring outside of the PASTAEBASTA platform. Customers are responsible for complying with any tax or reporting obligations related to cryptocurrency transactions in their jurisdiction. Supported cryptocurrencies, payment methods and payment providers may change without prior notice.

How it works

1) Add your items to your shopping bag.

2) Proceed to Checkout and select Cryptocurrency as your payment method.

3) You will be redirected to one of our authorized payment providers:

(a)Dream Finance OÜ - all supported by the service provider cryptocurrencies.
(b)Eterna Finance SRL - BinancePay payment method

4) Choose your preferred cryptocurrency.

5) Scan the QR code or copy the wallet address shown on the payment page.

6) Complete your payment within the 25-minute payment window.

7) Once your payment is confirmed, you will automatically be redirected to the PASTAEBASTA order confirmation page.

35. Dream Finance OÜ

Cryptocurrency payments (other than Binance Pay - see Section 36) are processed through our payment partner Dream Finance OÜ (https://cryptoprocessing.com). When you choose to pay with cryptocurrency, you will be redirected to Dream Finance OÜ’s secure payment interface to complete your payment; your payment obligation to us is satisfied once Dream Finance OÜ confirms successful receipt of payment, consistent with the mechanism described in Section 34 (Cryptocurrency Payments) and Section 38 (Failed Payments).

36. Eterna Finance SRL

Payments made via Binance Pay are processed through our payment partner Eterna Finance SRL (https://eterna.finance). The same principles set out in Section 35 for Dream Finance OÜ apply to payments processed by Eterna Finance SRL, unless expressly stated otherwise.

37. KYC

Where required by anti-money-laundering (AML) and counter-terrorist-financing (CTF) regulations applicable to our payment partners - in particular for cryptocurrency and Binance Pay transactions processed by Dream Finance OÜ and Eterna Finance SRL - you may be required to complete a Know-Your-Customer (KYC) verification before your payment is accepted or before funds/refunds are released. This may include providing a government-issued ID and other identity-verification information directly to the relevant payment partner. We do not control the KYC requirements or timelines set by our payment partners; delays in completing KYC may delay Order acceptance or refunds, and we are not liable for such delays to the extent they result from the payment partner’s independent regulatory obligations.

38. Failed Payments

If a payment attempt fails or is declined for any reason (insufficient funds, bank decline, card expiry, KYC not completed, cryptocurrency underpayment, etc.), your Order will not be accepted under Section 22(b) and no Contract is formed. We will notify you where reasonably possible and give you the option to retry with the same or a different payment method. We are not responsible for fees your bank, card issuer, or crypto wallet provider may charge in connection with a failed or declined payment attempt.

39. Exchange Rates

Product’s price is displayed in EUR but you pay using a foreign currency or cryptocurrency, the applicable exchange rate is set by the relevant payment processor (card issuer/network for fiat currency conversions; Dream Finance OÜ or Eterna Finance SRL for cryptocurrency conversions) at the time your payment is processed, not by the Company. Exchange rates for cryptocurrency payments can move significantly between the time you view a price and the time your payment is confirmed on-chain.

40. Payment Errors

If you believe you have been incorrectly charged - overcharged, charged twice, or charged after a cancelled Order - contact team@pastaebst.com with your Order number as soon as possible. We will investigate and, where an error is confirmed, correct it and issue any applicable refund via the original payment method (or, for cryptocurrency payments, per Section 41, Crypto Refunds in Part Three) within.

41. Promo Codes

Promotional/discount codes (“Promo Codes”) are subject to the specific conditions stated at the time they are issued (e.g., validity window, minimum order value, applicable Products/Collections, one-per-customer limits). Unless stated otherwise:

(a)one Promo Code may be applied per Order;
(b)Promo Codes have no cash value and cannot be exchanged for cash;
(c)Promo Codes cannot be combined with Gift Cards or other Promo Codes unless expressly stated;
(d)we may cancel or reverse a Promo Code discount, and may cancel the associated Order, where we reasonably suspect the code is being used fraudulently, outside its stated conditions, or through the creation of multiple accounts (Section 16(c)).

42. Gift Cards (not yet active)

PART THREE - SHIPPING, RETURNS & CONSUMER RIGHTS

43. Shipping

We ship to the countries listed at checkout. Delivery countries are provided by GLS and Poste Italiane service porviders. Shipping costs are calculated based on delivery destination, Order weight/size, and selected shipping speed, and are shown at checkout before you submit your Order.

44. Delivery

Estimated delivery times are shown on the Product page and/or at checkout and begin to run from the date of the dispatch-confirmation email (Section 22(b)), or, for Made-to-Order/Artist Finished Products, from the end of the applicable Production Time (Section 46). Delivery estimates are not guaranteed delivery dates unless expressly stated as such. If no estimated delivery date is provided, delivery will occur within 30 days of Order acceptance, consistent with Article 61 of the Italian Consumer Code / Article 18 of Directive 2011/83/EU.

Some Orders containing multiple Products may be shipped in separate parcels, which may arrive on different dates, at no extra cost to you.

45. Customs

For deliveries outside the EU, your Order may be subject to import duties, taxes, and customs clearance fees imposed by the destination country. We recommend checking with your local customs office before ordering to estimate the total landed cost. We are not responsible for customs delays, and failure to pay required duties or provide required customs documentation may result in your Order being held, returned to us, or destroyed by customs authorities - in which case Section 40 (Lost Packages) and applicable refund rules apply, but return shipping/duty costs already incurred are non-refundable.

46. Production Time

For Made-to-Order Products (Part Two, Section 27) and Artist Finished Products (Part Two, Section 28), an estimated Production Time is shown on the Product page - the time needed to produce/finish the item before it is shipped. Production Time runs from Order acceptance (Section 22(b)) and is separate from, and additional to, the shipping/delivery time in Section 44. TYPICAL RANGE, e.g., 2 - 5 business days, and it varies by Collection and from Artists.

47. Delivery Delays

If delivery is delayed due to an event outside our reasonable control (see Part Four, Section 51, Force Majeure), we will contact you as soon as reasonably possible to explain the delay and, where the delay affects the essential timing of the purchase, offer you the option to cancel for a full refund. Where a delivery date was not essential to the Contract, your statutory right to a reasonable extension or refund under Article 61 of the Italian Consumer Code applies if delivery does not occur within 30 days (or the agreed estimated date) and, after being asked to deliver within a further reasonable period, we still fail to do so.

48. Lost Packages

If tracking shows your Order as delivered but you have not received it, or if a package appears lost in transit, contact team@pastaebst.com within 14 days of the expected delivery date. We will investigate with the carrier and, where the package is confirmed lost, offer a reshipment or a full refund, at your choice.

49. Damaged Packages

If your Order arrives visibly damaged, please: (a) note the damage on the courier’s delivery record where possible; (b) photograph the packaging and the Product; and (c) contact team@pastaebst.com within 48 hours of delivery with your Order number and photos. We will arrange a replacement, repair, or refund at no cost to you, consistent with your legal guarantee rights under Section 55 (Defective Products).

50. Right of Withdrawal

If you are a Consumer purchasing from within the EU (and, where applicable, other jurisdictions with equivalent protections), you have the right to withdraw from your Contract without giving any reason within 14 calendar days, in accordance with Articles 52–59 of the Italian Consumer Code (Codice del Consumo) implementing Directive 2011/83/EU. The withdrawal period expires 14 days from the day you (or a third party you designate, other than the carrier) take physical possession of the Product - or, for an Order comprising multiple Products delivered separately, 14 days from receipt of the last Product.

How to withdraw: Before the withdrawal period expires, notify us of your decision to withdraw by an unambiguous statement - for example, an email to team@pastaebst.com stating your Order number. Money can be returned only to the same payment details wich was used during the payment.

Effect of withdrawal: If you withdraw, we will reimburse all payments received from you for that Order, including standard delivery costs (but not any supplement for choosing a delivery method more expensive than our standard option), without undue delay and in any event within 14 days of being informed of your decision to withdraw - although we may withhold reimbursement until we have received the returned Product(s) back, or you have supplied evidence of having sent them back, whichever is earlier and subject to our personal solution. Reimbursement will be made using the same payment method you used for the original transaction, unless you expressly agree otherwise, and subject to Section 56 (Crypto Refunds) for cryptocurrency payments.

Returning the goods: You must send back the Product(s) without undue delay and in any event within 14 days of communicating your withdrawal. We bears return shipping cost - standard EU default is the Buyer bears the direct cost of returning goods unless we agree to cover it; state your policy clearly here and align with Section 52, Returns. You are only liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning (i.e., normal “try it on” handling is fine; visible wear, missing tags, or damage is not).

51. Returns

Aside from statutory withdrawal (Section 50), we offer an extended goodwill return window beyond the mandatory 30 days subject to our own decision.

To start a return: DESCRIBE PROCESS – (e.g., via Buyer account "Returns" section, or by emailing team@pastaebst.com with the Order number. We will provide a return label / return address and carrier instructions.

Returned Products must be unworn, unwashed, undamaged, and - where applicable - with original tags and packaging intact, except to the extent normal inspection (Section 50) has occurred. Products failing this condition may be refused or subject to a reduced refund reflecting diminished value.

52. Refunds

Once a return is received and inspected (or, for statutory withdrawal, per the timeline in Section 50), we will process your refund to the original payment method within 7 business days of receiving the returned goods. You will receive an email confirmation once the refund is issued. Processing times to appear in your account/statement thereafter depend on your bank, card issuer, or payment provider and are outside our control.

53. Crypto Refunds

Refunds for Orders paid via cryptocurrency (Section 38, Dream Finance OÜ) or Binance Pay (Section 39, Eterna Finance SRL) are issued as follows, given the volatility of cryptocurrency values between the payment date and the refund date:

(a)the refund amount is calculated based on the original EUR-equivalent value of your Order at the time of payment, not the cryptocurrency amount originally sent, unless applicable law requires otherwise;
(b)the refund is paid back to the originating crypto wallet in the equivalent cryptocurrency at the prevailing rate on the refund date / OR in EUR to a bank account you provide;
(c)refunds via Dream Finance OÜ or Eterna Finance SRL may require KYC verification (Section 37) before release;
(d)network/gas fees or conversion fees charged by the payment processor for the refund transaction deducted from the refund amount.

54. Non-returnable Products

The following categories are excluded from the extended goodwill return window (Section 51) and, where applicable, from the statutory withdrawal right (Section 50) under Article 59 of the Italian Consumer Code:

(a)Made-to-Order Products genuinely personalised to your specification (Part Two, Section 27) - see the case-by-case note there;
(b)Artist Finished / hand-painted Products (Section 55 below);
(c)[ADD ANY OTHERS items marked as "final sale,", items that have been unsealed for hygiene reasons.

This exclusion does not affect your rights under Section 55 (Defective Products) if a non-returnable item arrives defective or not as described.

55. Hand-painted Products

Hand-painted or otherwise individually hand-finished Products (Part Two, Section 28, Artist Finished Products) are, by their nature, unique, non-identical pieces. Artist Finished Products are produced only after the Buyer orders them (bespoke), the exclusion is applies and is clearly disclosed on the Product page Some of them are pre-made and simply picked from stock and standard withdrawal right in Section 50 applies.

Natural variation in hand-applied colour, brushwork, or finish versus the reference photo is expected and is not treated as a defect (see Section 23, Colours), provided the Product is consistent with the range shown/described at the time of purchase.

56. Defective Products

All Products come with the statutory legal guarantee of conformity under Articles 128–135 of the Italian Consumer Code (implementing Directive (EU) 2019/771), lasting 2 years from delivery for physical goods. If a Product is defective or not conforming to its description:

(a)notify us at team@pastaebst.com with your Order ID number, a description of the defect, and photos, as soon as reasonably possible and in any event within 14 days of discovering the defect;
(b)you may request repair or replacement free of charge, unless impossible or disproportionate;
(c)if repair/replacement is not possible, disproportionate, not carried out within a reasonable time, or would cause significant inconvenience, you may request a proportionate price reduction or termination of the Contract with a full refund;
(d)a defect that becomes apparent within 60 days of delivery is presumed to have existed at delivery, unless we prove otherwise, consistent with Article 132 of the Italian Consumer Code.

This legal guarantee applies in addition to, and is not limited by, the withdrawal and returns provisions in Sections 50–54.

57. Chargebacks

If you initiate a chargeback or payment dispute with your card issuer or payment provider without first contacting us to resolve the issue, we reserve the right to suspend your account under Section 12 (Part One) pending resolution, and to contest chargebacks we believe are unfounded by providing evidence of the Contract, delivery, and these Buyer Terms to the payment provider/card network. We encourage you to contact team@pastaebst.com first - most issues can be resolved faster directly with us than through a chargeback process.

58. Complaints

If you have a complaint about a Product, an Order, or our service, please contact team@pastaebst.com. We aim to acknowledge complaints within 5 business days and to resolve them within14 days. If we cannot resolve your complaint directly, see Part Four, Section 54 (ADR) for alternative dispute resolution and the EU Online Dispute Resolution platform.

PART FOUR - LEGAL PROVISIONS

59. Copyright

All Content on the Platform - including photographs (licensed from Creators under the Photographer Licensing Agreement and Offerta agreements), Product designs, text, graphics, and the overall look and feel of the Platform - is protected by copyright and other intellectual property laws and is owned by, or licensed to, the Company. Purchasing a Product does not transfer any copyright in the underlying photograph or design to you; you receive ownership of the physical item only, together with the limited personal-use rights described in Section 61.

60. Trademarks

“PASTAEBASTA” and associated logos, and any Collection names (Section 21), are trademarks of the Company. You may not use these marks without our prior written consent, except to accurately describe or resell a genuine Product you purchased (nominative fair use), and never in a way that suggests endorsement, sponsorship, or affiliation that does not exist.

61. Photography Rights

The photographs featured in Products are licensed by their Creators to the Company under the Photographer Licensing Agreement referenced in the Terms of Use for Creators. As a Buyer, purchasing a Product bearing a photograph:

(a)gives you the right to own, use, display, and resell the physical Product itself;
(b)does not give you any right to reproduce, extract, crop, or otherwise separately use the photograph itself (for example, downloading the printed image and using it on a different product, in marketing, or online) without separate permission from the Company and/or the Creator;
(c)does not affect the Creator’s underlying copyright ownership of the photograph, which the Creator retains under the Photographer Licensing Agreement.

62. Customer Content

If you submit reviews, ratings, photos of your Product (“unboxing” images), or other Content to the Platform (Part One, Section 13), you retain ownership of that Content but grant the Company a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, display, and adapt it for the purpose of operating and promoting the Platform (e.g., displaying your review, featuring your photo in marketing), for as long as the Content remains on the Platform. You represent that you own or have the necessary rights to any Content you submit and that it does not infringe any third party’s rights.

63. AI Restrictions

You may not use the Platform, its Content, or the photographs embodied in purchased Products to train, fine-tune, evaluate, or build datasets for artificial intelligence or machine-learning models, whether generative or otherwise, without our prior written consent. This restriction is consistent with, and additional to, the AI-generated content prohibition that already applies to Creator submissions under the Terms of Use for Creators.

64. Website Scraping

Automated extraction of Platform data - including Product catalogues, prices, availability, and Content - via bots, scrapers, crawlers, or similar tools is prohibited without our prior written consent. This mirrors the prohibition on data mining/extraction found in comparable e-commerce terms and protects both our catalogue data and our Creators’ licensed photography from unauthorised bulk use.

65. Liability

To the maximum extent permitted by applicable law:

(a)the Platform and its Content are provided “as is” and “as available,” without warranties of uninterrupted or error-free operation;
(b)we are not liable for indirect, incidental, or consequential losses (such as loss of profit or business opportunity) arising from your use of the Platform or a Contract, except where such loss is a reasonably foreseeable result of our breach;
(c)nothing in these Buyer Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under mandatory product-liability law, or for any other liability that cannot be excluded or limited under Italian or EU law, including your statutory consumer rights under Sections 50 and 56 above.

Where a Product is defective and causes damage to other property or to you, mandatory product-liability rules under Italian Legislative Decree 206/2005 (Codice del Consumo, Title II) and Directive 85/374/EEC (as amended) apply and are not limited by this Section.

66. Warranty

Beyond the statutory legal guarantee of conformity described in Section 56, we do not offer any additional commercial warranty beyond the statutory legal guarantee described in Section 56" to avoid ambiguity.

67. Force Majeure

We are not liable for any delay or failure to perform our obligations under a Contract where that delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government action, labour disputes, internet or telecommunications outages, and carrier disruptions. Where such an event affects an accepted Order, Part Three, Section 47 (Delivery Delays) governs your rights.

68. Privacy

Our collection and use of your personal data - including registration data, Order and payment information, and Content you submit - is governed by our separate Privacy Policy (pastaebst.com/privacy-policy), which forms part of, and should be read together with, these Buyer Terms. By registering, checking out, or otherwise providing personal data, you acknowledge that it will be processed as described there, consistent with the GDPR (Regulation (EU) 2016/679).

Where personal data is shared with third-party payment processors (Dream Finance OÜ, Eterna Finance SRL, and the fiat card processor identified in Section 34 [renumber]) or carriers (Part Three), that sharing is described in the Privacy Policy and is limited to what is necessary to process your payment and deliver your Order.

69. Cookies

Our use of cookies and similar technologies on the Platform is governed by our separate Cookie Policy (pastaebst.com/cookie-policy).

70. Governing Law

These Buyer Terms, and any Contract formed under them, are governed by Italian law, without prejudice to any mandatory consumer-protection provisions of the country in which you, as a Consumer, are habitually resident, which continue to apply to you under Article 6 of Regulation (EC) No 593/2008 (Rome I).

71. Consumer Rights

Nothing in these Buyer Terms limits any mandatory right you have as a Consumer under the law of your country of residence, including the rights described in Sections 50 (Withdrawal) and 56 (Defective Products) above. Where any provision of these Buyer Terms conflicts with a mandatory consumer-protection rule that cannot be waived, the mandatory rule prevails.

72. ADR

If a dispute cannot be resolved through our complaints process (Part Three, Section 58), you may refer it to Alternative Dispute Resolution (ADR). EU-resident Consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. [ADD: name and contact details of the specific Italian ADR/consumer-mediation body you will designate, if any - required disclosure under Legislative Decree 130/2015 implementing Directive 2013/11/EU]

73. Entire Agreement

These Buyer Terms, together with the documents they expressly incorporate by reference (the Privacy Policy, Cookie Policy, and, where applicable, the Photographer Licensing Agreement for users who are also Creators), constitute the entire agreement between you and the Company regarding your use of the Platform as a Buyer, and supersede any prior agreements or understandings on that subject.

74. Severability

If any provision of these Buyer Terms is found by a court or competent authority to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
